Notes and Comments | The Directorate General of Prison Affairs is responsible for establishments that host adult population, both pre-trial and sentenced. At the last stages of the prison sentence, the offender can be placed in an open prison and/or be awarded conditional release. The DGPA is also responsible for monitoring sentenced persons who are at these last stages of the prison sentence although they spend more time in the community. By “young offenders” we understand individuals from 18 to 25 years old who have committed an offence. They are considered adults as they are 18 and older, but they are placed in the Young Offenders Prison (CP Joves) which is a specific prison dedicated to host offenders of those ages, namely “young offenders”. By “probation” we understand community sentences. The supervision of these is responsibility of the Directorate General of Probation and Juvenile Justice which also belong to the Ministry of Justice. The legal framework applicable to adult offenders, 18 years old and older, is mainly formed by the Criminal Code, Criminal Procedural Code, Prison General Organic Law and Prison Regulations. Minors 14-17 years of age, when have been given a custodial measure by the Juvenile Justice Judge, they are placed in Juvenile Justice centres which belong to the Directorate General of Probation and Juvenile Justice. These centres are ruled by the legal framework applicable to minors which is different from that applicable to adults and are not considered prisons. Minors can be given a community measure as well. When who has committed an offence is 13 years old or younger, is not considered to be criminally responsible and the case is managed by Child Protection. |

Notes and Comments | The term “prisoner population” in our system is not applicable to minors under 18 years of age. Minors from 14 to 18 who have committed and offence are being dealt with by the Juvenile Justice system, which means a different court jurisdiciton and a different set of measures is used. For this age group (14-18) prison is not forseen as a possible sentence but placement in a juvenile justice centre as well as many other possible “educational measures” (the terms punishment or sentence is not used in Juvenile Justice). They are not considered to be part of the “prison population” because juvenile justice centres and the principles informing a custodial measure for juveniles, differ significantly from a prison sentence in many respects. They are different in nature except for the “custodial” element, meaning they are not free to leave the centre when they please. With regard to the age at which an inmate is classified as elderly, it should be outlined that there is not a particular age at which an inmate would be classified as such as there is not any particular criteria to assess that someone should be considered “elderly” other than the retirement age. However, when and elder person requires special support due to their health or developmental conditions, they will be placed in a unit or wing together with other inmates with similar needs so they can be given appropriate support. |
