Introduction: The Portuguese Prison and Probation Services is now looking for European good examples in the field of building new prisons, in order to prepare an internal plan of action to build new prisons in the near future. The topics that are under analyses are the following: 1. Construction of new prisons: a. Policy and Strategy for the process of building new prisons b. Financing programs (Public funds and/or European funds)
Luxembourg is about to build a new pre-trial prison with a capacity of 400. Start-up is planned for 2022.

Despite the fact that no internal plan of action has been initiated, the Government agrees that the project of providing suitable accommodation for the prisoners within the framework of the capacity-building program by constructing new prisons is vital in our endeavor of conforming to the norms and regulations dictated by article 3 of the European Convention of Human Rights.

For cost-efficiency, the design and size of these new prisons will be standardized, based on a generalized and uniform plan. The requirements of the new institutions are listed in a document assembled by the Hungarian Prison Service..

The Estate Development Programme was instigated as a result of the Scottish Government’s response to the SPS Estates Review published in 2002. At that time, SPS identified that the Scottish Prison Estate, which consisted of mainly Victorian prisons and a collection of miscellaneous buildings that had been acquired over the years and adapted for custodial purposes, was no longer fit-for-purpose. One of the main concerns at that time was the lack of in-cell toilet facilities for prisoners and the increased likelihood of legal challenge by prisoners. This became reality only a few years later and such challenges continued up to 2010 and the ending of slopping out. Other key drivers for change came from the operational requirements for a modern prison system, including flexible buildings and facilities for prisoner activities and to allow offending behaviour to be addressed. The continuing increase in prisoner numbers, which were under 6,000 in 2000 and were at an average daily population of 7,851 during 2013/14, has also set priorities for the prison investment programme. The average daily population figure noted above excludes those on home detention curfew.

If yes, could you please detail the Policy and Strategy for the process of building new prisons?The forward Estate Development Programme assumes that action will be taken by Scottish Ministers over the next few years to eliminate the forecasted growth in the prisoner population over the period up to 2020. The current design capacity of the SPS Estate is circa 8,150. The next phase of the development programme is primarily designed to replace facilities which are not fit for purpose. As such it is not designed to substantially add to the existing design capacity.

In the Republic of Croatia there is no action plan for the construction of new prisons. In previous Strategic plan of the Ministry of Justice, construction of the new Penitentiary and Prison in Šibenik and additional building of the Prison in Zagreb were foreseen. Realisation of the project was planned from the budget of the Republic of Croatia, but half of the money was supposed to be ensured from the loan of the Council of Europe Development Bank (CEB). In the meantime, number of prisoners in Croatia significantly dropped down due to certain legislative changes so we no longer have the problem with prison overcrowding. According to this, planned construction was cancelled and revised Strategic plane no longer anticipates construction of new penitentiaries and prisons, but only improvement and small increase of accommodation capacities through reconstruction and adaptation. The only new construction foreseen by the Strategic plan is the one concerning construction of the new building and reconstruction of part of the existing buildings in the Juvenile Correctional Institution in Turopolje.

(Former Projects have been conducted to increase the number of cells)

In Norway, it is the Ministry of Justice and Public Security which is responsible for deciding where and when new prisons are to be built. At the end of 2014, the Government presented a white paper concerning the state of our prisons and the need for future prison capacity. This spring the Government will present a plan for increasing the prison capacity in the future. One of the main challenges for the Norwegian Correctional Service is old and dilapidated prisons. The prison properties’ owner, Statsbygg, has estimated the cost of needed renovations to be between 3.3 and 4.4 billion NOK. For a long period of time, lack of prison places has caused quite full prisons. The situation with full prisons has made it problematic to refurbish and/or remodel existing prisons. Simultaneously, it has led to what we call a «prison queue»; i.e. sentenced persons who have to wait for a prison place to be able to serve their sentence. As a measure to reduce the cost related to establishment and operation of prisons, The Directorate of Norwegian Correctional Service has developed a standardised prison building which is called «Model 2015». The “Model 2015”-prisons will be fully satisfactory buildings; both as to existing technical - and security standards. Further, they are planned to enable activities for all accommodated prisoners. When constructing module prisons the possibilities for daily activities and socialising with other prisoners are key factors. The so-called «Principle of Normality» has a strong position in the Norwegian correctional policy. This implies that prison-life should be as similar to life outside the prison walls as possible. It is the removal of freedom which is considered to be the punishment. The prisoner keeps his/her rights; such as the right to vote, the right to education, the right to health care services, etc. “Model 2015” will be used to extend Ullersmo and Eidsberg prisons. The modules will be preproduced with walls, roofs, floors and bathrooms. Thereinafter they will be packaged and shipped to the prison premises.

Yes. According to the Action Plan for Chapter 23, Judiciary and Fundamental Rights, there is a plan to build a new prison in Bijelo Polje.
If yes, could you please detail the length of the Plan of Action?After Montenegro in cooperation with the Development Bank of the Council of Europe agreed on the mode of cooperation, it is engaged in the project the Spanish design company IDOM, which should make a feasibility study. Meanwhile Montenegro is selecting location for the new prison. 18 months ago was formed working group for this project.
If yes, could you please detail the Policy and Strategy for the process of building new prisons?The existing prison in Bijelo Polje is an old building which reconstruction is unprofitable. It is also planned that the new prison has a department for long sentences, which so far has not been the case. The new prison will also meet all the required standards.

With every new prison, part of the old prisons will be closed.

What kind of financing programs are funding the construction of new prisons: Public funds and/or European funds / Others?In the summary of Order No.50 it is stated that there are 11 places of imprisonment out of which one is an open prison, one is a correctional institution for juveniles and one is a women prison. The placement of places of imprisonment in the territory of Latvia is historical and thus it is irregular – there are several prisons in Vidzeme and Latgale regions, in Riga alone there are four prisons and there is only one relatively small prison in Kurzeme region. Also, as some prison buildings have been built in the 19th century (oldest in 1833), some during the Soviet period and was then adjusted, while only a couple buildings are new or have been renovated, the condition of their infrastructure causes a number of problems. The goal of the development concept of the prison infrastructure is to create preconditions that would result in the necessary situation/infrastructure for effectively carrying out sentence execution (including resocialisation programs), as well as increasing the safety of society against the risks of unsafe prison infrastructure. The task of this concept is to develop a new prison system in which it is possible to provide effective arrest or sentence execution as well as to offer solutions for raising funds, necessary for realising the goal of the concept, in accordance with the state governing principles. For solving the current problems, in the concept the principles for the new prison system infrastructure development are noted, how the prisons should be placed in the territory of Latvia, where can the funding for the construction be found. The experience of Estonia and other European countries with solving these problems is used as a basis for this concept. The Programme for Modernization of Custodial Facilities was approved by the Resolution of the Government of the Republic of Lithuania No 740 of 22 July 2014. The Programme involves the building of new prisons and reconstruction of existing facilities. The aim of the Programme is to ensure safe, efficient and cost-effective operation of correctional facilities, proper living conditions as defined in legislation for inmates and detainees and proper working conditions for staff.

The modernization of custodial facilities is planned like this: during the short period (before 2016) is planned for implementation of the projects supported by the Norwegian Financial Mechanism and co-financed by the Republic of Lithuania and refurbishment of dormitory type premises at Marijampole Correction House into cell type premises financed from the State budget. Priority – relocation of Lukiskes Remand prison-Closed Prison in the outskirts of Vilnius and building of a new prison in Siauliai. Building of two more new prisons may be implemented at a later stage.

Other possible sources of financing: PPP and ESCO (energy saving company) model for renovation of existing buildings.
The programming plan had been launched with the Law no. 1133 of 1971, refinanced by Law 404 of 1977 and later in 2010 with the Prisons Plan, then closed in 2014, and currently still regulated by the above-mentioned Law no. 1133
