Introduction: The Austrian Federal Ministry of Constitutional Affairs, Reforms, Deregulation and Justice would like to collect information on the different scopes of responsibility the European Prison Administrations are falling. They are especially interested in the administrative organisation of prison services operating as an independent government agency or supervised by the Ministry of Interior.
The prison (and probation) services are organized as one agency The Swedish Prison and Probation Service.

The Belgian prison service is a department of the Ministry of Justice and is NOT operating as an independent government agency. This means that we are not in scope of the following 3 questions.

How is the personnel, do they have police officers or their own prison staff?The prison system of the Republic of Croatia is under the exclusive jurisdiction of the Ministry of Justice.
The Scottish Prison Service (SPS) is an agency of the Scottish Government and was established in April 1993. The SPS Framework Document sets out the policy and resources framework set by Scottish Ministers within which the SPS operates. As an Executive Agency, the SPS is funded by the Scottish Government. In line with the Framework Document, the SPS sets out its business objectives in the three year Corporate Plan for the spending review period 2017-2020 and an annual Delivery Plan which is published in the spring of each year. The SPS is a public service-led delivery agency which is legally required to deliver custodial and rehabilitation services for those sent to it by the courts. The SPS continues to deliver a range of operational services that contribute to the strategic outcomes, objectives and policies of the Scottish Government. Its principal objective is to contribute to making Scotland Safer by Protecting the Public and Reducing Reoffending. The SPS aims to achieve this by ensuring delivery of secure custody, safe and ordered prisons, decent standards of care and opportunities for prisoners to develop in a way that help them reintegrate into the community on release. To support this objective, SPS agrees a service framework with each public sector prison and manages private sector providers of prisons and custodial services under contract arrangements. There are 13 publicly managed prisons and 2 privately managed prisons (HMP Kilmarnock and HMP Addiewell).

Her Majesty’s Prison and Probation Service is an executive agency of the Ministry of Justice, governed in accordance with a framework agreement which can be found here: https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/605933/HMPPS_framework_document.pdf The agency has responsibility for providing public sector prison and youth custody services, and managing the provision of private sector prison and youth justice services. The agency is overseen by the HMPPS Board, who is responsible for all top-level agency decisions. The chief executive is responsible for the leadership of the Agency and its day to day management. The Secretary of State for Justice accounts for the Agency’s business in Parliament.
Are the Prison Administrations operating as Independent Government Agencies supervised by the Ministry of Justice or the Ministry of the Interior or perhaps an other Ministry?HMPPS is an executive agency of the Ministry of Justice with a Chief Executive who is responsible for leadership of the agency. They are accountable through the Permanent Secretary to the Secretary of State for Justice for performance of the Agency.
In case the Ministry of Interior is responsible for your prison administration, concerning the fundamental legal conditions, are there separations/barriers? How is the personnel, do they have police officers or their own prison staff?HMPPS staff are employed by the Agency and are civil servants governed by the Civil Service Code. HMPPS also has private sector staff and volunteers who are managed via contracts and agreements.
The Norwegian Correctional Service is organized as an agency under The Ministry of Justice.

The Criminal Sanctions Agency (= the prison and probation service) is subordinate to the Ministry of Justice. It operates under the guidance of the ministry and implements criminal policy defined by the ministry.

In case the Ministry of Interior is responsible for your prison administration, concerning the fundamental legal conditions, are there separations/barriers? How is the personnel, do they have police officers or their own prison staff?-
The Prison Department of the Republic of Lithuania is an institution acting as a separate budget institution, not a Department within the Ministry of Justice. Its administrative organization: Director General, 2 Deputy Directors General, advisers and 12 administrative units. Supreme prison service authority is the Director General who is accountable to the Minister of Justice.
Are the Prison Administrations operating as Independent Government Agencies supervised by the Ministry of Justice or the Ministry of the Interior or perhaps an other Ministry?The Prison Department of the Republic of Lithuania is an institution subordinate to the Ministry of Justice of the Republic of Lithuania. The state owns the Prison Department, the ownership rights and duties are implemented by the Ministry of Justice.

Latvian Prison Administration (hereinafter – LPA) is a state government organization under the Ministry of Justice.

In case the Ministry of Interior is responsible for your prison administration, concerning the fundamental legal conditions, are there separations/barriers? How is the personnel, do they have police officers or their own prison staff?LPA does not operate under the Ministry of Interior. LPA has its own prison personnel.
General Directorate of the Corps of Prison and Court Guard, prisons, remand prisons, juveniles´ prison and prison hospital (hereinafter referred to as „the Corps“) are independent government organisations established and dissolved by the Ministry of Justice of the Slovak Republic. At the same time, the Ministry controls the Corps and Minister of Justice appoints and removes from the office Director General of the Corps.

The Danish Prison and Probation Service is organised as follows: The supreme prison service authority in Denmark is the Department of Prisons and Probation who refers to the Ministry of Justice. Four Regional Offices refer to the department, and 24 local prison and probation facilities (open and closed prisons, local prisons, halfway houses, probation service)operate with reference to the Regional Offices.

In the context of this relationship, the Ministry of Justice may instruct the Department of Prisons and Probation on matters of organisational or strategic character and may have a role in decisions concerning individuals in the prisons and probation system. It is not possible to appeal decisions concerning individuals in custody from Department of Prisons to the Ministry of Justice.

How is the personnel, do they have police officers or their own prison staff?The Ministry of Interior is not involved in administration of prisons in Denmark.
