Introduction: The Ministry of Justice of Lithuania is considering the possibility to introduce prison clothing for all or part of prisoners and pre-trial detainees who are now wearing their own clothes. They believe that prison clothes, among other advantages, could help to reduce subculture and maintain order in prison.

All prisoners are provided with prison issue clothes on committal. However they may be permitted to wear their own clothes, on request to the Governor. They must have three sets of clothing.

No. They have the right to use their own clothes or they can choose to use prison clothes in closed prisons and in remand prisons, if they prefer it. In open prisons they have to use own clothes. (Using)Own clothes can be restricted, if the clothes could harm the safety or security in prison, like the clothes with signs of organized groups or clothes (like hooded jackets) which make it difficult to identity prisoners e.g. in monitors or otherwise. Work safety is a ground, too to restrict the right to wear own clothes.

The Basic Law indeed provides that detainees can wear civilian clothing, provided these comply with the hygiene, propriety, order or security standards imposed by a forced cohabitation with others. The prison provides decent clothing and shoes to detainees who do not wish to wear their own clothing and shoes. The rules of procedure specifies what type of clothing is permitted and in what quantity. Clothing similar to the uniform of the prison officers is not permitted. The chosen civilian clothing may not interfere with, unnecessarily slow down or hinder the correct enforcement of security regulations (e.g. conducting searches, screening by means of a walk-through metal detector, etc.). No detainees are excluded from wearing civilian clothing. In certain places of the prison, detainees are however required to wear prison clothing, e.g. jackets for visits, protective clothing at work, etc. Civilian clothing enters the prison from the outside. The frequency with which clothing can be changed depends on the penitentiary institution. The prison provides clothing for detainees who do not receive visits. In some penitentiary institutions, it is possible to purchase clothing via the prison to a limited extent. The chosen civilian clothing may not interfere with, unnecessarily slow down or hinder the correct enforcement of security regulations (e.g. conducting searches, screening by means of a walk-through metal detector, etc.). By 2020, this should have been implemented in all prisons.

In Croatian prison system prisoners can wear their own clothes, if so foreseen by the House Rules of the specific prison/penitentiary. Prison/penitentiary provides clothes to prisoners who don’t have, or don’t wish to wear their own. Prison director can withhold wearing of own clothes to prisoners for security reasons or reasons related to health and hygiene.

How often?In prisons/penitentiaries where House Rules stipulate wearing prison clothing, it is provided by the prison/penitentiary and it is consisted of shirt (short and long sleeves), short sleeves t-shirt, trousers, vest, summer and winter jacket and summer and winter cap. Prison clothes are dark-blue (jeans); prisoners receive them during the admittance to prison/penitentiary and afterword when necessary.

General answer to all questions: Until 1983 prisoners were obliged to wear prison cloths, which was experienced as stigmatizing and as an intent to break down their identity. Prisoners since then have the right to wear their own clothes, as long as it doens’t cause any danger for the order and security in prison (for instance: no shoes with iron caps are allowed). If a prisoner doesn’t have (enough) footwear and cloths, it’s the duty of the prison director to provide the prisoner with all necessary items.

In Sweden people who are detained are separated from those who are convicted, detainees are placed in other institutions (remand prisons). The following answers explain the circumstances for prisoners. Swedish prisons are classified as 1, 2 and 3. Class 1 prisons have the highest security, followed by class 2 and 3. Prisoners in class 1 and 2 have to wear prison clothes. In some prisons in class 3 prisoners may wear their own clothes.

How often?Prisoners are issued chinos, shorts, sweat pants, sweat shirts, T-shirts, fleece jackets, sport shorts, sport T-shirts, underwear, robes, hats, gloves, scarfs, socks and winter jackets or summer shell jackets. In addition to this there also are some skirts, tank tops and tights. Chinos and shorts are oatmeal, sweat pants, sweat shirts, jackets, hates, gloves, scarfs, socks, underwear and robes are grey mélange, T-shirts are steel blue and fleece jackets are maroon. Prisoners are issued a starter kit at arrival to the prison. The content in the starter kit differ between prisons but for example a prisoner gets one pair of chinos, one set of sweats, one fleece jacket, two sport sets, one robe, seven T-shirts, seven underwear, seven pair of socks and one set with hat, gloves and scarf (if it is that season). This is the usual set up for a week. Prisoners in class 3 are issued a suitable jacket for the season. Prisoners in class 1 and 2 share jackets, the jackets are issued when they are allowed to go outside.

A detainee may were his or her own clothes but can also be provided clothes from the Swedish Prison and Probation Service. These clothes are green. Prisoners, regardless of he or she are placed in isolation or not, wear the same clothes.
Wearing of the garment components (parts of clothing) by the inmates is in the Slovak Republic legally regulated by: • The Act No. 221/2006 Coll. on Pre-trial Detention Execution as amended and the Regulation of the Ministry of Justice of the Slovak Republic No. 437/2006 Coll. that issues the Rules of Pre-trial Detention Execution as amended, • The Act No. 475/2005 Coll. on Prison Sentence Execution as amended and the Regulation of the Ministry of Justice of the Slovak Republic No. 368/2008 Coll. that issues the Rules of Prison Sentence Execution as amended, The Prison Governor may allow inmates to wear their own clothing and footwear under the conditions stated in the above mentioned regulations.
If yes, please, describe what clothes they are issued? What colour? How often?Garment components are provided to inmates according to determined patterns and standards set by an internal regulation. As basic clothing accused persons are assigned tracksuit (jacket and trousers) and convicts uniforms for convicts (coat and trousers; imprisoned women are provided skirt in summer). Other garment components of the same colours and patterns (in various shades of blue) are provided to inmates. Garment components are assigned to inmates upon their admission to execution of pre-trial detention or prison sentence. The replacement of the garment components is ensured at regular intervals stated in the above mentioned regulations.

Garment components for inmates are mainly produced by employment of inmates at the correctional industries. Other garment components are provided by external suppliers under the conditions stated in the Act on the Public Procurement.

According with Section 13 Part 1 Clause 9 of the Law On the Procedures for Holding under Arrest, an arrested person has the right to wear personal underwear, clothing and footwear. According with Section 41 Part 2 of the Sentence Execution Code of Latvia, convicted persons shall wear their personal clothing or the type of clothing stipulated in accordance with the internal procedural regulations of the deprivation of liberty institution. According with Section 77 Part 8 of the Sentence Execution Code of Latvia, convicted persons who are serving their sentence at the lowest level of the sentence serving regime in closed and partly-closed prisons shall be provided with the type of clothing and footwear provided for in the internal procedural regulations of the deprivation of liberty institution. According with Section 14 of the Cabinet Regulation No.423, adopted 30 May 2006 "Internal regulations of imprisonment place" states that inmates wear seasonally appropriate personal clothes or clothes of specific standard with attached name card. In the annex of these regulations there are noted standard clothing.

How often?According with Section 7 of the Cabinet Regulation No.1022, adopted 19 December 2006 "Regulations on the material provision standards for prisoner nourishment and household needs" (hereinafter – Regulations No.1022), clothing and footwear standards for one prisoner is set according with Annex 4 of these regulations. After a set sanitary treatment, prisoners can be issued used clothing and footwear. According with Annex 4 "Clothing and footwear standards for one prisoner" of the Regulations No.1022: 1.For men: 1.1. Winter hat, 1 pc; 1.2. Summer hat, 1 pc; 1.3. Winter coat, 1 pc; 1.4. Suit, 2 sets; 1.5. Shirt, 2 pc; 1.6. Warm underwear, 2 sets; 1.7. Underwear, 2 sets; 1.8. Socks, 6 pairs; 1.9. Shoes or boots, 2 pairs; 1.10. Slippers, 1 pair; 1.11. Pants, 1 pc. Normative acts do not denote specific timeframe, for how long the previously mentioned items are issued, in addition, they do not denote the colour.

In general, prison clothing is mandatory for prisoners in Estonia. There are a few exceptions from this general rule, however. Firstly, prisoners whose imprisonment is executed in open prisons are allowed to wear personal clothing. Secondly, persons who are in custody are also allowed to wear personal clothing.

How often?The regular prison clothing consists of the following articles of clothing: a T-shirt, trousers, shorts, a skirt for women if deemed necessary, a jacket, a winter jacket, a winter hat, a summer hat, mittens and a neck warmer (a certain type of scarf). Adult prisoner’s clothing is brown and underaged prisoners wear orange clothing. Prisoners are issued prison clothing on arrival and new articles of clothing are issued to prisoners based on necessity (when the old ones need to be replaced). Based on necessity, socks and underwear can also be issued by prisons. It is also noteworthy that prisoners who have suicidal or self-harming tendencies can be issued special clothing e.g. easily tearing paper clothing to avoid hangings and strangulations. The same applies for prisoners who are deliberately ripping clothes apart to destroy the property of prison. There are also some differences between regular prison clothing and clothing issued for prison work. Depending on the weather a jacket or shorts can also be issued. Moreover, for the daily walk a winter jacket, mittens, a neck-warmer and a hat can be issued. The colour of the clothing worn in isolation varies in different prisons and is currently being determined.
