Introduction: The Republic of Turkey Ministry of Justice General Directorate of Prisons and Detention Houses would like to give shape to the future use of technology in prisons in their country. For this reason, they would like to gather information about the rules governing the use of mobile phones by prison administrators and prison staff in closed prisons.

The Swedish Prison and Probation Service has its own regulations allowing administrators and other staff to carry mobile phones that belong to the prison inventory.

According to sec. 55 par. 4 letter a) of the Act no. 4/2001 Coll. on the Corps of Prison and Court Guard, as amended (hereinafter referred to as “Act on the Corps”), a person entering a protected building (so, also including any prison officer and civil employee of the Corps) is forbidden to bring weapon, means of audiovisual equipment or other unauthorized item by which life, health or safety of persons and property could be endangered in the protected building (prison facility). In accordance with internal regulation of the Act on the Corps, means of audiovisual equipment refers to camera, video camera, broadcast equipment, recording equipment, mobile phone or notebook/laptop. Exceptions to this prohibition are determined by: A) Sec 15 par. 2 of the Act on the Corps (President of the Slovak Republic; Prime Minister of the Slovak Republic; Chairman of the National Council of the Slovak Republic and by them determined persons; Minister of Justice of the Slovak Republic; State Secretary of the Ministry of Justice of the Slovak Republic; Head of Service Office of the Ministry of Justice of the Slovak Republic and by them determined persons; General Prosecutor of the Slovak Republic; Deputy General Prosecutor of the Slovak Republic and Prosecutor executing surveillance over observance the rule of law in prison facilities; Chairman and Deputy Chairman of the Constitutional Court of the Slovak Republic; Public Defender of Rights; Commissioner for Children and Commissioner for Persons with Disabilities; Chairman and Deputy Chairman of the Supreme Court of the Slovak Republic; authorities of the Council of Europe in charge of control over the execution of pre-trial detention and prison sentence; Ordinary of the Ordinariate of Armed Forces and Armed Corps; General Clergyman of the Head Office of Ecumenical and Pastoral Service; Judge if decided or decides in criminal case of accused or convicted person; intervening member of rescue units of the integrated rescue system); B) Director General of the Corps or Prison Governor in accordance with sec. 55 par. 4 of the Act on the Corps. At present, following exceptions are determined by internal regulation (Order of Director General of the Corps): - exceptions for service mobile phones – service mobile phones are assigned to determined prison officers; e.g. Director General of the Corps and his Deputies; Prison Governor and his Deputies; Directors of Departments of the General Directorate of the Corps, etc. - individual exceptions for private audiovisual means - Director General of the Corps grants authorization for all prison facilities and Prison Governor grants authorization for particular prison facility. These exceptions are mainly made for individual cases that are detailed recorded and in the most cases they are applied only in administrative premises of the prison facility.

The Offender Management Act 2007 made it a criminal offence to convey specific items, including mobile phones and associated equipment into or out of a prison or to transmit sounds or images from within a prison (without authorisation). In March 2012, the Crime and Security Act 2010 also made it an offence, with a penalty of up to two years’ imprisonment and/or an unlimited fine, to possess an unauthorised mobile phone or other electronic equipment or component element that can receive or transmit information electronically within a prison. This is applicable to all staff, contractors and visitors to the prison. There are some exceptional circumstances where written authorisation can be given for a mobile to enter the prison for example a police mobile during an incident that is crucial to lines of communication but these authorisations must be signed off by director level.
