Introduction: At the moment the Corps of Prison and Court Guard is busy with preparation of background materials for the new management of the Ministry of Justice of the Slovak Republic. On this occasion, we would like to ask you for help and cooperation by provision of information on some selected topics concerning inmates.

What is the average amount of the work remuneration per inmate in 2017, 2018 and 2019 and is it bound to any valorisation mechanism? What are the financial limits for the individual meal rations/norms?CSA offers a menu of three (3) types of food for lunch and another menu for dinner, one of which consists of a special diet.
What items are included to the determination of the meal rations amounts?The cost per inmate/day was of 145€ in 2018 and 152€ in 2019. This amount includes all costs related to the interventions carried out with the inmate with regard to treatment, activities inside the prison (gym, cultural activities, library), activities outside the prison necessary for their rehabilitation, services such as health, education, sustenance, job placement promotion schemes, security, staff, police amongst others.

If yes, are there any exceptions from this obligation (e.g. sick-leave, pensioners, inmates included to education/courses, etc.), or eventually do the inmates perform any works for free?Neither pre-trial nor sentenced inmates are obliged to work in accordance with art. 25.2 of the Spanish Constitution, which reads as follows “Punishments entailing imprisonment and security measures shall be aimed at rehabilitation and social reintegration and may not consist of forced labour. The person sentenced to prison shall enjoy during the imprisonment the fundamental rights contained in this Chapter except those expressly limited by the terms of the sentence, the purpose of the punishment and the penal law. In any case, he shall be entitled to paid employment and to the appropriate Social Security benefits, as well as to access to cultural opportunities and the overall development of his or her personality.”
What is the amount of the work remuneration for inmates in your country and how is this remuneration distributed – to which individual items?The work remuneration that inmates receive when they work in the prison is laid down by art. 15 of the Royal Decree 782/2001 which governs the special labour relations of sentenced inmates that undertake labour activities in prison as well as the Social Security coverage for individuals sentenced to community work under probation. Hence the amount of remuneration received by inmates is determined by the type of work carried out and the amount of time the individual has been effectively working, calculated against the basis of the minimum wage that year. According to the law, every year a remuneration grid is approved for such calculations.
What is the average amount of the work remuneration per inmate in 2017, 2018 and 2019 and is it bound to any valorisation mechanism?In 2017, the average pay for 4 hours of work was 14,78€, in 2018 14,06€, and in 2019 14,30€. The valorisation mechanism is the remuneration grid approved annually.
What types of meal rations/norms do you provide to inmates including nutrition therapies and diets, what events are assigned to them? What are the financial limits for the individual meal rations/norms?The meals for the inmates are provided by an external company that has won a public tender. The meals that are being served per day include breakfast, lunch and dinner. The types of menues this company has to prepare are the following: • General or basic • Vegetarian • Muslim, including the specific requirements during the month of Ramada On 7 special dates a year (Christmas, new year, ...) the company provides special meals without charging any additional cost. Under Medical prescription, the company shall also provide meals suitable to an hyposodic diet, hypo or hypercaloric diets, diabetic diet or specific foods intolerances diets amongst others. A packed lunch or “picnic” will be provided to all inmates that for any reasons will not be able to be at the prison at a meal time (transfer to another prison, court hiring, day leaves, etc...) The costs of a meal without VAT are the following: breakfast 1,90€; lunch 3,80€ and dinner 3,80€.

There is an earned privileges system in place called ‘Incentivized Regimes’ whereby prisoners who do not infringe prison rules and who engage in education, training, work or other structured activity earn a higher daily gratuity amount, increased phone call and visits privileges
What is the amount of the work remuneration for inmates in your country and how is this remuneration distributed – to which individual items?Prisoners who engage in work within the prison to provide services that the Irish Prison Service would otherwise have to pay for (e.g., catering, cleaning, laundry, waste management, maintenance of buildings and grounds) are paid an additional €0.50 per half day. This is called the Approved Work Gratuity. The maximum that an individual prisoner can receive per week from a combination of the daily gratuity and the Approved Work Gratuity is €18.90 per week. A small number of prisoners (c. 20) who are accommodated in one of the two Open Prisons are approved temporary am/pm day release to work for an approved employer externally. The payment of wages, which must comply with the statutory minimum wage (before income tax and other statutory deductions) is paid into the prisoner’s account in the prison.

What are the financial limits for the individual meal rations/norms?The Irish Prison Service operates an approved 28 day menu cycle, which meets all of the nutritional requirements of prisoners and also caters for people in custody with special dietary needs. The average cost of prisoner meals was €5.66 per day in 2019.
What items are included to the determination of the meal rations amounts?Taking the reference of 2019, the cost per one inmate/day is 64,79 euros.

Every work is voluntary. Nevertheless, there are personal obligatins as, for example, cleaning common spaces used by inmates.

The media of worker per month is: 2017: 12.145. 2018: 12.357. 2019: 12.279.
What is the average amount of the work remuneration per inmate in 2017, 2018 and 2019 and is it bound to any valorisation mechanism?The data are the following: 2017:258,76 euros. 2018:266,91 euros. 2019:274,40 euros. The average amount of the remuneration is calculated in relation to a module that takes different items as reference. Mainly: minimun public income, holidays and bonus.

What are the financial limits for the individual meal rations/norms?There are different types os menus depending on healthy and religion reasons. Generally, there is no concret financial limit.
What items are included to the determination of the meal rations amounts?The menu has to provide the medium energy and variety, considered appropiate for the general population.
In 2019, the average cost for a day of care (in prison or remand prison) was SEK 3,219 per client. The amount includes all types of expenses such as personnel costs, premises costs, other operating costs, financial costs and depreciation.

However, clients in prison must, according to law, be offered some occupation. It does not have to be work, it can also be education, treatment programs, etc. This type of occupation provides compensation. If the client is ill, he/she does not need to participate. A retiree do not have to participate in occupation but may be offered to participate.
What is the amount of the work remuneration for inmates in your country and how is this remuneration distributed – to which individual items?The clients in prison must be offered occupation for at least 6 hours and at most 8 hours per day depending on normal working hours in prison. Normal compensation: SEK 13 per hour in prison. Half normal compensation at illness or when occupation cannot be assigned. If you have a retirement pension or receive paid sickness or activity compensation you only receive compensation when you actually performed an employment. The compensation in remand prison is SEK 11 per hour.

What types of meal rations/norms do you provide to inmates including nutrition therapies and diets, what events are assigned to them? What are the financial limits for the individual meal rations/norms?Inmates in prison or remand prison are offered breakfast, lunch, dinner and a simple evening meal daily. On average, the cost of ingredients is about 19 SEK per meal. If you add costs such as salaries, consumables, waste, machine depreciation, electricity, water and rent for the facilities, the total cost will be approximately SEK 100 per inmate and day. However, this may vary slightly between different prisons and remand prisons. The Swedish Prison and Probation Service provides three dietary options; normal diet, adapted diet for religious reasons and vegetarian diet. In addition to these alternatives, personalized meals are provided for people with a serious illness, food allergy or who for other medical reasons require a special diet as prescribed by the attending physician.

Detainees has a right to work. The obligation/right can be full filled participating work activities, education, vocational training, treatment programmes ect. Sick inmates are payed 80% of the normal remuneration.
What is the amount of the work remuneration for inmates in your country and how is this remuneration distributed – to which individual items?The weekly workhours is 37 hours. The inmates are payed remuneration per hour - actually (2020) 10,80 kr. per hour. All activities are payed equal. The inmates are payed per week on their individuel account. The inmate can achieve 2 additions to the normal remuneration per hour. Both additions are 3,29 kr. per hours.
What is the average amount of the work remuneration per inmate in 2017, 2018 and 2019 and is it bound to any valorisation mechanism?The workhours are 37 hours pr. week/ app. 1858 hours per year. In 2017 the average remuneration per inmate was 24.674 kr. In 2018 the average remuneration per inmate was 25.157 kr. In 2019 the average remuneration per inmate was 25.677 kr. (3.423 Euro) The rates are regulated by the state once a year.

What are the financial limits for the individual meal rations/norms?Detainees are provided with all meal by the Prison Service. The meal offers respects cultural differences, special diets ect. The average cost is app. 10 Euro per day. Prisoners are preparing all meal for them selves and they can buy all foodstuff in the prison shop/ or from a shop outside the prison. Inmates are payed app. 10 Euro per day to buy raw materials for the cooking.

Only the following categories of prisoners are not required to work: 1) prisoners of more than 63-years of age; 2) prisoners who are acquiring general or vocational education or participating in in-service training for the purpose of professional development; 3) prisoners who are unable to work for health reasons; 4 prisoners who are raising a child of less than three years of age. Person in custody doesn’t have to work. If a person in custody wishes to work and the prison service can allow it, they may work.
What is the amount of the work remuneration for inmates in your country and how is this remuneration distributed – to which individual items?By the law, remuneration of a prisoner has to be at least 10% of the minimum wage rate. The minimum wage for a full-time job offered by a prison is actually 95.87 euros per month. And this is established by the regulation of The Government of the Republic. Minimum wage in Estonia is established by the regulation of The Government of the Republic on the basis of the Employment Contracts Act and it is 584 euros since 1st January 2020. The prison service shall transfer the wages of a prisoner and other funds paid to the prisoner to the internal personal account of the prisoner. Of the funds deposited in the personal account of a prisoner, 50 per cent shall be reserved for the satisfaction of monetary/financial claims, 20 per cent shall be deposited as a savings fund to be handed over to the prisoner on release and the rest of the funds shall be reserved for the use of the prisoner inside the prison pursuant to the internal rules of the prison. If no monetary/financial claims exist against the prisoner or if the claims amount to less than 50 per cent of the funds in the prisoner's personal account, the corresponding funds in the personal account of the prisoner shall also be deposited as a savings fund to be handed over to the prisoner on release. The savings fund shall be deposited in the amount equal to three times the minimum monthly wages established by the Government of the Republic. What are the financial limits for the individual meal rations/norms?According to the law the provision of food for prisoners shall be organised in conformity with the general dietary habits of the population with a view to meet the food requirement necessary for survival. Prisoners shall be ensured with dietetic food as prescribed by a medical officer. As far as possible, prisoners shall be permitted to observe the dietary habits of their religion. So dietary meals are prescribed for medical or religious reasons. If a prisoner is allergic to a specific food product (e.g. eggs), the prisoner is provided with food without the food product causing the allergy (e.g. egg free food). The following diets are most common: diet for diabetics, lactose-free, gluten-free, pork-free, meat-free and fish-free diets.

Rule 31(5) states “An unconvicted prisoner shall be permitted, if he wishes, to work as if he were a convicted prisoner.

What are the financial limits for the individual meal rations/norms?Public Sector Prison Industries (PSPI) manage the delivery of catering across 105 Public Sector Prisons in England and Wales. They provide 90 million meals each year, ensuring that every prisoner is provided with 3 meals a day that are safe, varied, nutritious and meet the religious, cultural and medical needs of all. Since April 2017, decisions on the food budget - and what type and quantity of meals are provided - rests with the governing governor of each individual prison. Meals are provided through consultation with prisoners and are based on a multi choice pre- select system, which takes into account religious and cultural beliefs. Catering Breakdown - Daily Delivery Choices available consist of meat and fish protein, vegetarian and vegan choices. Prisons should also offer 2 portions of oily fish per week as part of that. Fresh fruit is available daily. The Ministry of Justice (MoJ) has responsibility for providing instructions to prisons on the provision of meals for prisoners. The MoJ recognises the importance that a balanced diet provides to prisoners and the role food plays in the safety and security of prisons. Religious Provision Prisons have a responsibility to provide meals that meet the religious and cultural needs of all prisoners and to recognise and support them to follow their religious and cultural beliefs. Provision of Halal Halal meals are provided to prisoners in accordance with the requirements set out in Prison Service Instruction 51/2011 - Faith and Pastoral Care for Prisoners and Prison Service Instruction 44/2010 - Catering Meals for Prisoners. All Halal meat and poultry that is available to procure through our national suppler is slaughtered and certified in accordance with Islamic Law. Costs Since 2017, when budgets were devolved to prison governors, decisions as to how much is spent on food lies with the respective prison governor. There is no set amount. In 2014 the cost per head was notionally £2.02. With inflation and over time this has now increased to around £2.15.
