Introduction: The Austrian Directorate General for the Administration of Custodial Sanctions and Measures involving Deprivation of Liberty was invited by a legal company that covers the financial interests of artists to sign a contract for the payment of copyright fees concerning the use of TV-sets on the one hand by inmates and on the other by the staff in common recreation rooms in prisons.
In Spain there is no similar fee on the use of tv.

Have you (the prison administration) to pay such fees and, if yes, what is the price for the use of one TV-set each year.Some prisons have contracts for the provision of TV service with service providers and pay a subscription fee for their services, while others use digital terrestrial TV, where the number of channels is limited. Prison administration do not pay the copyright fees, but, possibly, these are included in the provider’s fee for the TV service.

General Directorate of the Corps of Prison and Court Guard centrally for all prison facilities makes the reimbursement of royalties for the use of works by public performance by means of technical facilities (thus, not only TV, but also radio broadcasting of other forms of reproduction) via a collective licence agreement with the Slovak Performing and Mechanical Rights Society (SOZA) Hence, this fee is not bound to the individual TV-sets.

There is no copyright fee for the use of television in Latvian prisons. Sub-paragraph 24.10 of Recommendation Rec(2006)2 of the Committee of Ministers to Member States on the European Prison Rules states that prisoners are allowed to take a regular interest in public activities, incl. listening to radio or TV broadcasts. The use of television in prisons shall be ensured by a company in accordance with a signed contract.

With regard to the TV sets used individually by inmates in their cells (purchased by themselves), no fees are being charged on copyright grounds. The same applies to the TV sets placed in the common areas of the prison to be watched collectively by inmates or in common areas for the staff (cafeteria), no copyright fees are being paid neither.
