If yes, at what stage in the judicial chain process is the definition applied to the crime and how is the definition formulated?In Belgium, the definition we use is = Honour-related violence is any form of mental or physical violence committed by a collective mentality in response to an (imminent) violation of the honour of a man or woman, whereas his or her family and the outer world is aware or is likely to be aware. This is not laid down in law. In practice, we will use a combination of the general disposition in our penal code (f.ex. murder, assault and battery,…) and an article that defines aggravating circumstances, because the violence is used, because of the fact that the victim is a woman (or a man). F.ex. Art. 393. CP : L'homicide commis avec intention de donner la mort est qualifié meurtre. Il sera puni de la réclusion de vingt ans à trente ans. +Art.405quater CP : Lorsqu'un des mobiles du crime ou du délit est la haine, le mépris ou l'hostilité à l'égard d'une personne en raison de sa prétendue race, de sa couleur de peau, de son ascendance, de son origine nationale ou ethnique, de sa nationalité, de son sexe, de son changement de sexe, de son orientation sexuelle, de son état civil, de sa naissance, de son âge, de sa fortune, de sa conviction religieuse ou philosophique, de son état de santé actuel ou futur, d'un handicap, de sa langue, de sa conviction politique, de sa conviction syndicale, d'une caractéristique physique ou génétique ou de son origine sociale, les peines seront les suivantes : 1° dans les cas visés à l'article 393, la peine sera la réclusion à perpétuité; … An example to make it more clear: In 2012 we had a conviction in a case of honour-related violence. A woman was murdered by her brother (with consent of the parents and her sister) because she didn’t want to marry the man that they chose. The Court of Assizes decided that she was killed by her family on the grounds that she would have dishonoured her family by refusing to conform to the role that she’s been allocated as a woman, because she didn’t want to be forced into marriage . Four members of her family were sentenced to prison terms, ranging from five to twenty-five years . The brother who murdered the woman, got fifteen years in prison. The sister five. The parents were found guilty as co-offenders, because they approved to the murder. Discrimination on grounds of sex, was considered an aggravating circumstance. The Court has also recognized that gender stereotypes lead to serious discrimination against women on the grounds of their sex .

If yes, at what stage in the judicial chain process is the definition applied to the crime and how is the definition formulated?In article 2352.1 of the Civil law of Latvia is defined that „Each person has the right to bring court action for the retraction of information that injures his or her reputation and dignity, if the disseminator of the information does not prove that such information is true”. However law does not define - what is an “honor-related” crime. To this definition might be close concept “Defamation”. In the dictionary of legal terms “Defamation” is defined as person’s honor and dignity humiliation, inappropriate handling with it, belittling its self-esteem feelings, it can be done orally, in writing or with actions. Disputes about honor and dignity humiliation are dealt in the court of general jurisdiction and there is no criminal liability for honor and dignity humiliation.

If yes, could you give a short description of the intervention/treatment/program?In Latvian imprisonment places are implemented social behavior correction, social rehabilitation and Christian education programs, but their content is not directly aimed to clients who are serving their sentence for "honor-related" crimes. In year 2013 for clients who had committed crimes related to definition "Defamation" were provided such resocialization programs: Social rehabilitation programs: - 'Value education and communication skills' - Skirotava's prison Social behavior correction programs: - 'Integration and communication promotion' - Cesis Correctional institution for juveniles; - 'Sex offender program' - Valmiera's prison, Cesis Correctional institution for juveniles*, Daugavgriva's prison (In Valmiera's prison, Cesis Correctional institution for juveniles „Sex offender program" was implemented to offenders who have committed particularly serious criminal offenses, but they are not sex offenders); - EQUIP
