Introduction:
Austrian prisons directors are civil servants and appointed for an indefinite period of time.

Special Remarks or CommentsAccording to the Law on the Enforcement of the Prison Sentence, minister of justice admits prison directors and their deputies to a public service, appoints them to position and allocates to specific working place. Minister also decides on their dissolution, relocation in case of dissolution and about termination of their public service. Directors and deputy directors are appointed to their position on indefinite period of time, until their dissolution or until their termination of public service (usually retirement).

Previously, prison directors were appointed by the Director General. Since the beginning of year 2013, prison directors are appointed by the Director of Criminal Sanctions Regions.

Special Remarks or CommentsUsually prison directors are appointed for a indefinite period of time, but may be appointed for a definite period taking into account the interests of the service in accordance with Law On the Career Course of Service of Officials with Special Service Ranks Working in Institutions of the System of the Ministry of the Interior and the Prisons Administration (Article 12, Part 1, Point 1).

Has the legislation regarding prison directors appointment been changed?No. The Prison (Scotland) Act 1989 makes provision for the "Central Administration" of prisons. Rule 3 provides for the "General Superintendence of Prisons" and provides that the Secretary of State, for which reads Scottish Ministers, may appoint "governors and the other officers of prisons".
