Introduction:
Closed conditions have wall and/or wired fence, grids, cameras, higher number of custodial officers - judiciary police officers (ratio of about one officer per two prisoners), little freedom of movement, a lot of supervision, etc. Semi-open conditions are usually bordered only by simple fence, have large areas where a lot of different activities can take place (agricultural areas, different workshops, premises and areas for sport activities etc). Prisoners can move inside institution with a little supervision and can achieve bigger range of different benefits, such as home-leaves. Number of custodial officers is smaller than in closed conditions (ratio of about 1 officer per 4 prisoners). Open conditions are even more loosened then semi-open in a sense of security and freedom of movement, but in all other characteristics are more or less the same. Biggest difference is that in open penitentiary there are no custodial officers at all.
If yes how many privilege levels exist in your prison system?Three levels – closed, semi-open and open. Prisons are all closed and penitentiaries can be closed, semi-open and open. No matter its basic level of security, each institution can also have closed, semi-open or open wards.

What is the percentage of prisoners in these different privilege levels?Around 80% in closed conditions, 15% in semi-open and 5% in open conditions. Here we need to emphasize that in closed conditions we place convicted prisoners but also prisoners in remand custody while in semi-open and open conditions we only place convicted prisoners.

Special Remarks or CommentsThe Danish Prison System does not operate with different levels of privilege. It is noted, that a concrete assessment of the individual prisoner with regard to safety, however can prompt differences in e.g. the prisoner's freedom goods.

What is the percentage of prisoners in these different privilege levels? Special Remarks or CommentsThere are no fixed privilege levels, except differences inherent in or derived from the basic statute or regime (pretrial prisoners vs. convicts; closed prison vs. semi-open prison or half-way detention). Some bonuses may be granted on an individual basis (e.g. additional visits); these are however not considered as privileges, rather as useful measures to be taken for the benefit of the person or in the interest of his rehabilitation. A reduction or loss of certain entitlements (TV, PC, ...) may constitute part of individual disciplinary or security measures.
PREPS operates through a reporting system based on responsible behaviour, performance at constructive activities and participation in offending behaviour programmes (where applicable), thought necessary to assist inmates to lead law abiding lives upon release. The scheme operates on three regime levels; Standard, Enhanced and Basic. All inmates will join the scheme at Standard regime level. Regime levels are transferrable between establishments. Ostensibly there are differences between the regimes in relation to privileges and earnings. The prisoner earnings for the regimes are: Prisoner on Basic Regime = £4.00 Prisoners on Standard Regimes = £11.00 Prisoners on Enhanced Regime = £20.00 Privileges The following are examples of privileges. Levels of access will vary depending on regime level. The Governor will approve the level of privileges under each regime level which will be displayed on landing notice boards. - additional visits - time out of cell - additional gymnasium - television Promotion and demotion decisions will be based on patterns of behaviour. Isolated incidents, whether good or bad, will not generally impact on regime levels. An appeal process is available. Inmates will be encouraged to make written responses about their reports and reports will be quality assured to ensure that decisions and recommendations made are consistent and fair.
If yes how many privilege levels exist in your prison system?There are three main privilege levels within our Prisoners Regime and Earned Privileges Scheme (PREPS) Basic, Standard and Enhanced. To attain and remain on Standard regime level inmates must – - attend activities on time, engage and perform to an expected standard as set by the provider - demonstrate a willingness to conform to the Offender Management Plan and address offending behaviour to help reduce the risk of reoffending - conform to regimes, routines, rules and regulations - demonstrate good behaviour towards staff, visitors and other inmates - keep themselves and their room clean and tidy and dress appropriately - comply with all terms and conditions of any form of temporary release - cooperate with drug/alcohol testing and with use and care of medication guidelines - support equality of opportunity - support aims to reduce bullying, self-harm and vulnerability amongst inmates To attain and remain on Enhanced regime level inmates must – - exceed the expectations for Standard regime - accept responsibility for their offending behaviour (sentenced inmates including those appealing the severity of their sentence) - comply fully with an agreed Offender Management Plan - demonstrate that they can be trusted to work with a reduced level of supervision - demonstrate a willingness to use their personal time constructively Basic regime will only be used for those who do not meet the expectations for Standard regime. - Unacceptable behaviour will be addressed by the development of individual improvement targets (action plans) based on conduct, education and employment and offending behaviour programmes, where applicable, set against Offender Management Plan targets. - inmates on Basic regime will retain their statutory entitlements in accordance with Prison Rules - inmates on Basic regime will be reviewed regularly to motivate and assist them to move to Standard regime

The progressive regime mentioned under point 2 distinguishes itself by the following phases: Normal execution This regime can take various forms according to the dangerousness of the prisoner. Some prisons have top-security sectors, within which the prisoners can spend till 23 hours a day in cell. For the prisoners who represent a lesser danger, the ordinary regime is more flexible. The inmates have then to work, but they are given the opportunity to undergo basic and advanced training and to practice sport. They must also be able to benefit from certain liberties, which allow them to maintain contacts with the outside world (visit, release on temporary licence). These liberties intervene then gradually throughout the execution of the sanction. Day release employment and external accommodation If the inmate has served a minimum one half of the custodial sentence and it is not expected that he will abscond or commit further offences, he can benefit from a more flexible regime which has for objective to prepare him on the way of release. The sanction is then executed in the form of day release employment. If the prison inmate proves himself to be of good behaviour in day release employment, the further execution of the sentence takes the form of external accommodation and day release employment. Parole If the prison inmate has served two thirds of his sentence, he shall be released on parole if this is justified by his conduct while in custody and it is not expected that he will commit further felonies or misdemeanours.
If yes how many privilege levels exist in your prison system?The Swiss criminal law plans types of execution which differ according to the duration of the sanction. The short-term sanctions are executed, as possible, according to more or less flexible regimes. For the longer sanctions, the execution is made according to a progressive regime which becomes lighter over time, until the prisoner is released.

Special Remarks or CommentsThe differences between these privilege levels is the length of stay outside of prison (1 to 3). Level 4 includes working and level 5 is only for juvenile offenders. Mainly, we can only differentiate in our statistics between closed and "open prison". "Open prison" means that they can leave the prison during day-time.
If yes how many privilege levels exist in your prison system?According to §46 ThürJVollzGB, there are five different levels in our prison system: 1. Leaving the prison for 24 hours in company 2. Leaving the prison for 24 hours alone 3. Leaving the prison for days 4. Working outside of prison 5. Approved school for juvenile offenders According to §50 ThürJVollzGB, there are less requirements six month before dismissal for the purpose of re-integration.
