Introduction: The Irish Prison Service is currently processing prisoner bails in its prisons on behalf of the Irish Courts Services. We are interested to find out the processes in place in other prison services.

The Prison Service is a part of the Home Affairs Ministry and this issues are under the competence of the Ministry of Justice.
The possibility of release on bail is very uncommon in Denmark and very rarely used. If used, the procedure does not involve the Danish Prisons and Probation Service.

The court has to decide on a case by case basis whether the defendant presents such a bail risk as to warrant custody. It has to carry out a risk assessment, balancing the risk which releasing the defendant on bail may pose to the public or the administration of justice, against the consideration that it is a serious step to remand in custody. Where the court grants bail, it does so under certain conditions which include that the defendant attends court, does not commit another offence while on bail and does not interfere with witnesses or otherwise obstruct the course of justice. The court may also decide to impose certain requirements to help ensure that the defendant complies with these conditions and to help mitigate any other identified bail risks. Such requirements may include a security and a surety.
If yes, do you accept cash payments for bails?Security is money paid into court before the defendant is allowed out on bail. This must be paid into court in cash or other cleared funds.
If cash is not accepted, how are prisoner bails processed in your country for prisoners in custody?Surety is money promised to the court by third parties (e.g. family members) and is only paid if the defendant does not answer bail or turn up to court. It may take the form of money in a bank account or other assets such equity in a property. Documentary evidence must be provided to the court by solicitors showing that this money is available, or that assets equivalent to that amount exist. This could be in the form of a bank statement or a mortgage statement accompanied by a house valuation.

For this purpose, the requested amount must be deposited into the account of the Deposit and Consignment Office, according to the payment instructions communicated by the Public Prosecutor's Office.
