Introduction: The Prison Service of the Czech Republic would like to get a better idea of what the system of employing highly qualified inmates (on positions they were trained for/they studied for) looks like in your agency. In particular, we are interested if there is any practice of employing inmates-medical doctors on corresponding positions within the prison service. Thank you for your answers.
In a specific way that we explain in the next question.
If yes, can you give some examples of positions on which you currently employ such inmates with medical degrees?It is not a medical degree, but we have the possibility that they follow specific training and they contribute in some activities. Mainly, taking care of other inmates in risk of suicide.

Inmates with a degree of medical doctor, nurse or other healthcare practitioners are not allowed the practice their healthcare positions.

No, this is not allowed in our system.

The current generally binding regulations do not prohibit employing inmates with a medical degree on the positions of medical doctors, provided that this person along with an unconditional prison sentence was not imposed by the prohibition to undertake the activities of a doctor or was not declared guilty by a final judgment for a particularly serious criminal offence, offence against human dignity, offence related to children pornography, offence of trafficking in human beings, offence of placing a child under the control of another, offence of passive bribery, offence of active bribery, offence of trading in influence and an intentional offence committed in connection with the performance of the medical profession. In addition to the above mentioned legislative conditions, in order to include an inmate on the medical position, it would be necessary also to perform assessment of his personal and security preconditions for the performance of this special activity (opinion of psychologist, preventive security service and chief doctor).
If yes, can you give some examples of positions on which you currently employ such inmates with medical degrees?At present, we do not have any employed inmate with the 2nd university degree in the field of general medicine. At least in the last decade, we have no record on an inmate that would work on the position of a service doctor or a doctor of a prison medical department or who would have the necessary classification for that.

Section 56(5) Part 4 of the Sentence Execution Code of Latvia (hereinafter – the Code) states that the work and trades, in which employment of convicted persons is prohibited, shall be determined by the internal procedural regulations of the deprivation of liberty institutions. According with Clause 80 of the Cabinet Regulation No.423 dated 30 May 2006 "Internal Procedural Regulations of the Deprivation of Liberty Institution"1 (hereinafter – the Regulation No.423) the employment of convicted persons is prohibited: - in work related to video equipment, radio equipment, computer equipment and communication equipment; - in the work of a seller, accountant, cashier, warehouse manager of food and industrial goods, as well as in other positions related to material liability; - in positions where the convict would be under the authority of the staff of the custodial institution. According with Section 562 Part 1 of the Code, a convicted person shall be employed for remuneration, if he or she has lodged a written submission to the head of the deprivation of liberty institution and the convicted person may be employed in the deprivation of liberty institution or outside it. While Part 2 of the Section states that convicted persons shall be employed for remuneration: 1) in the facility management of the deprivation of liberty institution; 2) at work places created by merchants in the deprivation of liberty institution; 3) outside the deprivation of liberty institution if permitted by the sentence serving regime imposed on the convicted person. Consequently, the normative acts that regulate the employment of convicts in a custodial institution do not provide for the possibility to employ convicts with medical education in the positions of doctors and other medical staff. In the facility management of the prison, convicted persons are employed in the following positions - cook, kitchen worker, warehouse worker, laundry manager, hairdresser, shoemaker, cleaner, repair worker, auxiliary worker (boiler house).

NHS England/ Improvement (NHE/I) is responsible for commissioning and delivering health services in prisons in England. The Ministry of Justice (MoJ) and Her Majesty’s Prison and Probation Service (HMPPS) are responsible for delivering prisons that facilitate and promote good health outcomes, by ensuring they are safe and decent. In Wales, healthcare is devolved to the Welsh Government, which delegates responsibility for healthcare commissioning to Local Health Boards. This does not include substance misuse services for offenders, which are commissioned by HMPPS and local Police and Crime Commissioners.

Providers do not employ or otherwise draw on the services of inmates with a medical degree, training as medical doctors or other highly trained healthcare personnel.
